What should a driver do if the car documents are stolen?

If documents for a car are lost, people prefer to refer to the loss in order to quickly restore the papers; in this case, they will not have to visit the police station. But it is worth remembering that rights and other documents can be used by attackers for illegal purposes, and their owner will have to bear responsibility. If your car documents are stolen, it is better to report the theft to avoid unpleasant consequences.

When applying to the police station, the applicant is given temporary certificates. Also, temporary certificates will be issued if the applicant indicates that he himself lost the documents. These papers are valid while the verification is carried out.

Driving a car without documents is prohibited. If the driver decides to violate administrative legislation, he will have to pay a fine in accordance with Art. 12.3 of the Code of Administrative Offenses (CAO).

What should a driver do if his car documents are stolen?

It is necessary to act consistently to restore stolen documents and rights:

  1. Notify the traffic police about the incident as soon as possible. You have to hurry, because another person can drive the car with someone else’s license, and he can do it while intoxicated. If the violator is caught, the decision to revoke the license will be issued to the true owner of the car.
  2. Pay the state fee. For a paper ID it is four hundred rubles, and for a plastic ID – three thousand (the fee has been updated from July 2022).
  3. Receive a decision that a criminal case has been initiated or a decision to refuse to initiate one.
  4. Contact the traffic police with the received resolution.
  5. Get a temporary certificate. To obtain a temporary certificate, you need a passport, an application, a document confirming completion of training to drive a certain category of vehicle. The fee for obtaining a temporary certificate is 800 rubles.
  6. Go to a technical inspection point for diagnostics.
  7. Apply for a new MTPL policy at an insurance company. To contact the insurance organization, the driver will need a vehicle passport and a registration certificate.

Difficulties in recovering lost documents - How to deal with them...

Do you, gentlemen, think that if you lose the documents for your car, as well as your driver’s license with an identity card, you will be able to restore everything in a short time..(?) Do you also think that if you lose a set of documents for your car, you will be able to use your car without any problems? You friends are very much mistaken. And the reason for this is the gaps in our Russian legislation. Dear readers, we invite you today to learn about the consequences of losing a registration certificate, driver’s license, passport, and including an MTPL policy. You can also learn from this article the entire algorithm for subsequent actions that will help you quickly and promptly navigate this difficult situation.

Where to contact

To restore documents, you should contact the traffic police. If they require an insurance policy, you will have to contact the employees of the insurance company to obtain a duplicate. If you are reinstating your policy for the first time, you will not have to pay for the service. Subsequent actions are paid at rates established by the insurer.

If you don’t have the time or desire to go through the authorities, then you can restore the documents through the State Services portal. The procedure is as follows:

  1. Register on the website gosuslugi.ru.
  2. Select the “Electronic Services” section.
  3. Specify "Ministry of Internal Affairs".
  4. Select the item “Registration of vehicles”.
  5. Specify “Receiving duplicates”.
  6. Fill out all fields of the form.
  7. Pay the state fee. When receiving services through the site, applicants pay a fee with a reduction factor.
  8. Come to the traffic police department on the appointed date and get duplicates.

Lost your insurance policy

To restore a lost MTPL/CASCO insurance policy, the driver needs to contact the office of his insurance company. The insurer has an internal database and issues a new insurance policy based on it. If the car’s registration certificate is also being restored at the same time, then you need to contact the insurance agent with a request not to fill out the “type of document” column. As soon as the duplicate PTS is received, the motorist independently enters its number and series into the policy. The same data is reported to the insurer.

How to fill out an application correctly

The application must list which papers were missing and under what circumstances this happened.
If there are people you suspect of committing the theft, you need to record this information. Describe in detail the alleged crime scene and the time it occurred. If you have any difficulties filling out the application, you can contact the duty officer for advice and assistance. If the application is made with errors or corrections, MREO employees may refuse to accept it. A justified refusal is issued to the applicant.

Issuance of a temporary identity card

In the same Main Directorate of the Federal Migration Service, after all the necessary documents have been submitted to restore the passport, you can request a temporary identity card. There shouldn't be any special problems here. The relevant paper will be issued immediately, maximum in 1-2 days. Difficulties may arise, perhaps, for citizens of the Russian Federation who are carrying out the procedure for obtaining a passport in a region other than their own. Due to additional checks, you will have to wait a little. Is it possible to somehow speed up the process in this case? Probably yes. To do this, you will have to give as many identification documents as possible to the migration department: registration, driver’s license, international passport, etc.

The temporary identity card is valid for two months. If necessary, it can be extended, but there will be little point in this: a new passport should definitely be issued within two months.

How to recover what was lost

If the license is stolen, the motorist will not have to obtain a medical certificate or retake the driving test. A certificate must be obtained only if the validity period of the old license has expired. List of documents for restoration through the traffic police:

  • passport;
  • statement;
  • photo 3*4;
  • training completion card;
  • receipt for issuing a new document.

If your passport is lost, the documents cannot be restored.
A military ID or individual taxpayer number (TIN) will not replace a passport. Therefore, you first need to restore it, and then only get your license. Documents with an international passport from the applicant are also not accepted. You can get a license instead of one that was stolen from you or you happened to lose at your place of temporary residence. For example, if a citizen who came to Sochi from the Tver region on vacation lost his license, then he will be able to restore his documents there. Whether there is registration or not, it does not matter according to Resolution No. 1097.

There are two options for document recovery:

  1. With the issuance of a temporary certificate.
  2. New rights are issued immediately, if the MREO employees are not very “overwhelmed” with work.

The latter case is more convenient for the driver, since documents are issued on the same day. The new document will differ from the old one in that the “Duplicate” entry will appear in it. Placement is in the “Special notes” column. The duplicate contains the following data:

  • last name, first name and patronymic of the applicant;
  • place and date of issue;
  • categories and subcategories that the driver can control;
  • expiration of rights.

Special security measures are affixed to the duplicate: a marking barcode, contour microtext, and entries are made with luminescent paint that are visible in the light. It is issued against receipt, which is recorded in the MREO registration journal and the traffic police database. The validity period of the duplicate is the same as that of the stolen document.

Let's go to the Main Directorate of the Federal Migration Service

With the coupon that was issued at the police station, you will need to go to the local branch of the state administration of the Federal Migration Service (formerly FMS). In addition to the coupon, you will need to take with you the following documents to restore your passport:

  • statement of theft (a sample is not needed here, the form can be free);
  • application in 1-P format about the need to issue a new passport;
  • a receipt for payment of the state fee of 1,500 rubles;
  • 2 personal photos.

At the same time, GUFMS employees can also ask the citizen:

  • military ID;
  • birth certificate;
  • Marriage certificate;
  • document on registration at the place of residence and some other documents.

What can you say about the timing of passport production? As a rule, a new document must be produced within 10 days. However, if the applicant did not submit the application to the local GUFMS, or not all documents for passport restoration were submitted to the department, then the processing time may take up to 2 months.

Is it possible to drive a car without a license while it is being restored?

While documents for the car are being prepared, you should drive with a temporary license. Driving without a license is as prohibited as driving with invalid documents. The violator will have to pay a fine of 5 to 15 thousand rubles. A motorist also pays a fine if he has lost his license but has not contacted the traffic police.

Important! If a motorist received a temporary license and during the period of its validity changed his place of residence, then a new license is issued in place of the lost one before the month period expires. To do this, the driver must provide supporting documents about the move.

If a citizen of Ukraine or another country’s rights were stolen in Russia, then they cannot be restored on the territory of the Russian Federation. A foreigner will be able to restore documents in his homeland. To obtain a Russian license, you need to pass an exam and undergo a medical examination on a general basis.

If a Russian citizen’s license was stolen while he was abroad, then you should contact the local police station. The applicant is given a protocol certified by the seal and signature of the police chief. The certificate is issued only upon return to your home country. It’s convenient that now you don’t have to stand in line to get your license back. You can make an appointment through the State Services website and arrive at a certain time.

Possible troubles

The mere fact that documents were stolen is already a big nuisance. However, the possible problems may not end there. Moreover, they will be created not by some criminal elements, but by servants of the law. What exactly are we talking about?

We recommend! Muscovites do not want to pay fines: “I paid the fare, but they are making a ‘hare’ out of me”

It is not always possible to prove that a passport was actually stolen. In such cases, the police may pay attention to the provision of the Code of Administrative Offenses of the Russian Federation, which establishes liability for the loss of documents due to negligence (Article 19.16). Of course, the sanction here will be negligible: only 100-300 rubles (from 2 to 5 thousand rubles for living at the place of registration without a passport). However, we have to agree: to feel “guilty without guilt,” and even after a real theft, is a truly bleak situation. But so far no one has canceled the appeal procedure, which can be used at any time.
