The court decision states that the transfer was made “based on the client’s order.” As it turned out, D. received a fake SMS on his phone about the operation. “If you haven’t made the transfer, call me back” is a classic. A similar situation with unlawful access to confidential data is described in the decision of the Nizhneudinsk City Court dated November 22, 2016. A completely different case is in the decision of the Sosnovy Bor City Court dated February 25, 2020. Plaintiff B. asked to recover 800 thousand rubles from PJSC KB Vostochny. damage and a number of other amounts. Having opened a deposit at the bank, she suddenly lost this amount: the money was stolen from the card by scammers.
One of them was even found and convicted, and in his testimony he described the theft in detail. There was no fault of B. in what happened, but there were obvious omissions in the work of the bank.
