What are smoking mixtures?
Initially, what is now called spice was sold legally. Punishment for spreading spice
Article 228.1 of the Criminal Code of the Russian Federation provides for criminal liability for the production and sale of narcotic and psychotropic substances, including spice.
For distributing spice in a small amount, the offender faces imprisonment for a term of 4 to 8 years, with or without restriction of freedom for a term of up to 1 year.
If the distribution was carried out via the Internet and the media, the convicted person is subject to imprisonment for a term of 5 to 12 years. In addition to this punishment, the court may decide to restrict freedom for a period of up to 1 year and impose a fine of up to 500 thousand rubles or the salary of the convicted person for a period of up to 3 years.
The sale of spice in a significant amount is punishable by imprisonment from 8 to 15 years. A fine of up to 500 thousand rubles or in the amount of the offender’s income for a period of up to 3 years, and imprisonment for up to 2 years may also be imposed.
For the sale of spice carried out by an organized group, as well as for the sale on a large scale, those convicted face imprisonment for a term of 10 to 20 years. The court may rule on a ban on holding certain positions for a period of 20 years and impose a fine of up to one million rubles or in the amount of the convicted person’s income for a period of up to 5 years.
The sale of narcotic substances on an especially large scale is punishable by imprisonment for a term of 15 to 20 years or life imprisonment. At the same time, a fine of up to 1 million rubles or the amount of the convicted person’s income for a period of up to 5 years may be imposed.

Signs of use and effects on the body

Thus, for possession of spice, a person can be subject to a fairly severe punishment in the form of imprisonment. This is regulated by Article 228 of the Criminal Code of the Russian Federation.
In accordance with the Criminal Code, for the illegal acquisition, storage, transportation of spice in a significant amount, one of the following penalties is applied to the offender:
- a fine of up to 40 thousand rubles or in the amount of a person’s income for a period of up to 3 months;
- compulsory work lasting up to 480 hours.
- correctional labor for up to 2 years;
- restriction of freedom for up to 3 years;
- imprisonment for up to 3 years.
For transportation and storage of spice in a significant amount, the offender faces imprisonment from 3 to 10 years. The court may also impose a fine of up to 500 thousand rubles or the amount of the convicted person’s income for three years, and also make a decision on restriction of freedom for up to 1 year.
For illegal acquisition, storage, or transportation of spice in a particularly large amount, the convicted person faces imprisonment for a term of 10 to 15 years. In addition to this punishment, a fine of up to 500 thousand rubles or in the amount of a person’s income for a period of up to 3 years may be imposed. The court may also decide to restrict freedom for up to one and a half years.
Is it possible to avoid responsibility?
It is impossible to avoid punishment for the distribution of spice under the Criminal Code of the Russian Federation. This is only possible for drug users. Article No. 6.9 of the Code of Administrative Offenses of the Russian Federation specifies specific conditions for exemption from liability:
- The detainee himself voluntarily sought help from medical institutions, which confirmed his drug addiction. If he agrees to rehabilitation, he may be released from liability.
- The detainee is under 18 years of age and is ready to voluntarily seek medical help.
The problem of the spread of spice and other drugs requires active action to combat drug distributors. Therefore, responsibility is being tightened and changes in the chemical composition of the spices themselves are being monitored, adding new compounds to the list of prohibited ones.
Caught with spice - what's the danger?
To date, there is no criminal liability for the use of spice. However, this does not mean that the offender will not be punished. Firstly, a person may be brought to administrative responsibility. In accordance with Article 6.9. Code of Administrative Offenses of the Russian Federation for the use of smoking mixtures, the offender faces an administrative fine in the amount of 4 to 5 thousand rubles or administrative arrest for up to 15 days.
The same punishment threatens a person who refuses to undergo a medical examination for drug intoxication at the request of an authorized official, if the latter has sufficient grounds to suspect the detainee of using narcotic and psychotropic substances. If a foreigner is caught using spice, in addition to the above punishment, he will face forced deportation from the Russian Federation.

It also turned out that Bobokulova was under the influence of drugs at the time of the crime. Psychiatrist-narcologist Alexander Krylasov, in an interview with the Moskovsky Komsomolets newspaper, explained what drugs could so strongly and rapidly affect the behavior of a usually calm woman. “She could have been pumped full of spice and programmed to do the things she did. There are drugs that you just need to add to tea to blow your mind away for a long time,” the doctor said.

The murder that occurred in Podolsk near Moscow in October 2015 is very reminiscent of the case of FSB Lieutenant Colonel Ignatiev. On October 18, 30-year-old Dmitry Milovanov killed his young children - a 4-year-old son and a 9-month-old daughter, and tried to kill his wife. The outbreak of aggression happened suddenly - during the most ordinary family evening. Dmitry grabbed a knife and inflicted numerous wounds, first on his son, then on the baby. He tried to stab his wife, but he was stopped by his nephew, who was also in the apartment at that time.
According to neighbors, the family was prosperous; they had recently returned to the Moscow region from Thailand, where they had lived for the last two years. Why the man attacked the family is unclear to them. “Perhaps he smoked something the day before, maybe he brought it from Thailand, or maybe he bought it here. You know, they say that such atrocities are committed under spice,” the Milovanovs’ neighbors voiced their versions to the press.

An equally terrible incident occurred in one of the cities of the Sverdlovsk region at the beginning of September last year. On the outskirts of Nizhnyaya Tura, children discovered a terrible discovery: black plastic bags containing parts of a human body. The other two decided to dismember him and take his body outside. Since they were in an inadequate state after smoking spice, they decided to film everything that was happening and post the video on YouTube,” investigators commented on the actions of the criminals.
The killers have been identified. It turned out that before this they were not such good boys: in the Nizhny Novgorod region, the young people managed to commit several crimes, but these were mainly petty thefts. It didn't come down to "merry murder".

A few hours after the teenagers were detained, a video appeared online in which Lev B., the organizer of the attack, uses drugs on camera, calling it “the highest, highest recreation.”
According to one of the accounts on the social network VKontakte, this is a “designer” drug α-PVP. “Side effects can be serious and life-threatening, and deaths have been reported. Some researchers have found such psychopathological effects in users as psychotic behavior, delusions and hallucinations and self-harm, confusion, anhedonia, anorexia, panic attacks,” the author of the post quotes an article from Wikipedia on this substance.
