The concept of insult to personality in the administrative and criminal code

Any insult is mental aggression against an individual and a violation of his rights. That is why insult is punishable by law; a person can receive real punishment for a boorish attitude.

In law, an insult is considered an action that meets the combination of the following characteristics:

  • it represents an unflattering, offensive assessment of a person;
  • is a humiliation of the inherent qualities of a person - his honor and dignity.

Anything said to another person will be an insult if its content:

  • has an indecent connotation;
  • contradicts the norms of morality and ethics accepted in society.

Defamation of human dignity can be expressed verbally, these are offensive, humiliating words and nicknames. You can also hurt honor in writing, for example, by depicting inscriptions or drawings of a humiliating content on a person’s personal belongings or property.

You can insult not directly, but, for example, by speaking unflatteringly about someone, knowing that the words will definitely be conveyed to the person.

Humiliation of honor and dignity can be expressed physically - kicking, pushing, spitting. The victim does not receive physical damage, but his moral state suffers.

Insult must be distinguished from another concept in law - slander. In slander, the offender deliberately disseminates deliberately false, untrue information about a person. Their reliability is zero and has nothing to do with reality. A slanderer, defaming another person, usually acts in pursuit of selfish goals. For example, one colleague passes on false, defamatory information about another to management in order to take his place.

What article is punishable for insulting a person?

Previously, until 2011, an article for insulting a person was provided for in the Criminal Code (Article 130). Currently, the fact of causing insults is decriminalized, i.e. is not a crime. The exception is cases when the personality of a person performing official duties is humiliated, which we will discuss below.

The exclusion of humiliating acts from the norms of criminal law is due to the fact that the offender does not pose a threat to society and his isolation is not advisable. In addition, a criminal record has negative consequences for the offender in his future life.

Thus, an article for insulting a person is provided for in the Code of Administrative Offenses (Article 5.61).

To constitute an offense, the following elements are required:

  • the insult is intentional;
  • the truthfulness of the statements does not matter.

It often happens that expressed insults have negative consequences for a person, he experiences suffering, and loses the support of part of the community. In this case, it is possible to file a claim in court for compensation for moral damage under Article 151 of the Civil Code of the Russian Federation.

Insults against certain special subjects of law are still a criminal offense:

  • derogatory statements addressed to participants in the trial (Article 297 of the Criminal Code of the Russian Federation);
  • insults to government officials, including law enforcement agencies (Article 319 of the Criminal Code);
  • unflattering review of a person liable for military service (Article 336 of the Criminal Code).

To initiate a criminal case, it is important that the insult occurs while the listed officials are performing their official duties. The public danger of such acts is to undermine the foundations of statehood and impede the work of government bodies.

Varieties


In the 21st century, it is not necessary to throw insulting words at people’s faces; crimes move to the Internet. A person may not even know for some time that he is being humiliated if the information is posted on social networks.

There are other ways to belittle:

  • unpleasant phrases may be called over the phone, or defamatory information may be disseminated on the Internet;
  • sending a letter or telegram with humiliating content;
  • telling details from life to third parties;
  • body movements without touching - showing certain gestures;
  • movements with touching, but without causing physical pain to the victim - pouring liquid, tearing off items of clothing.

In any of these situations, there is a demonstration of negative feelings that have arisen towards a person.
The offender deliberately shows his disrespect. Responsibility for minors begins at the age of sixteen. The Administrative Code also provides for other types of violations. Humiliation of human dignity and honor is one thing, but petty hooliganism is another offense. Collection for it is provided for in Art. 20.1 Code of Administrative Offences. The initiation of cases of petty hooliganism is the responsibility of the police, and the magistrate's court deals with them.

Important! Article number 150 of the Civil Code of the Russian Federation (Civil Code) guarantees the right to protection of personality, honor, good name, and human dignity. Every person from birth has the right to privacy.

Types of insults

The article for insulting the personality of the Code of Administrative Offenses of the Russian Federation consists of several parts.

Humiliation of facial dignity

Derogation of a person’s dignity must be expressed in an indecent form: words, writing, physically, gestures.

When is dignity considered violated? Each person considers this for himself. For example, the boss called me a moron. There are many options for reacting to name-calling: from complete ignorance to psychological trauma.

From the objective side, humiliation of dignity is manifested in the fact that a person is subjected to a negative assessment, which helps to undermine his authority in the eyes of others and damage to self-esteem.

The insult must be expressed in an indecent form. The concept of “indecency” is not enshrined in the law, which often causes difficulties in determining the guilt of the offender in practice.

Most often, words related to the following topics are regarded as abusive and indecent:

  • classification as representatives of the animal world (“donkey”, “goat”);
  • related to race;
  • names of sewage and waste;
  • intimate sexual nature.

Personal insults are always directed against a specific person.

If swear words sound out of place and are addressed to everyone nearby, then the article can be classified as hooliganism.

Public insult

You can humiliate a person one on one. It’s another matter if the insult is made publicly, i.e. it can be heard or seen by an indefinite circle of people.

Such an insult can be expressed:

  • in the media: in the newspaper, on television;
  • in a public speech from the podium, for example, at a conference;
  • in front of witnesses, other people, for example, colleagues.

In the modern world, degrading statements on the Internet, social networks, and WhatsApp groups are made public.

Public insult is a more serious offense compared to private one. This is understandable: the name of a humiliated person appears on all corners, rumors and speculation appear, his existence in a certain community becomes problematic.

Punishment for insult to personality

The sanctions that will be imposed on the offender under the article for personal insult are given below.

Humiliation of honor and dignity

  • If a citizen insults you, you will be fined from 1,000 to 3,000 rubles.
  • In case of humiliation by an official - a fine of 10,000 to 30,000 rubles.
  • If the honor is affected by a legal entity - a fine from 50,000 to 100,000 rubles

Public insult

  • If a citizen insults you, you will be fined from 3,000 to 5,000 rubles.
  • In case of humiliation by an official - a fine of 30,000 to 50,000 rubles.
  • If the honor is affected by a legal entity - a fine of 100,000 to 500,000 rubles.

What to do if you are humiliated and insulted

Everyone decides for themselves whether it is worth “contacting” the offender within the framework of the law. You can answer on your own, you can “swallow” the insult. But still we must defend our honor, preferably according to the law.

If you decide to contact law enforcement agencies to punish the aggressor, keep the following in mind:

  • Look for witnesses. If the humiliation was public, then there will be no problems. When you are insulted one-on-one, you will have to look for evidence.
  • Photos and video materials are accepted to confirm the offense. If the insult is committed in writing, then the recording will be sufficient.

In situations where you expect that the interlocutor will use offensive statements without witnesses, you can turn on the voice recorder during the conversation. It’s good to talk about the date and place of recording in advance. If unpleasant posts are contained on social networks, you need to take a screenshot of the corresponding page and have it notarized.

Cases under Article 6.51 of the Code of Administrative Offenses of the Russian Federation are initiated by the prosecutor and are subject to consideration in the magistrate's court. An application to bring the offender to administrative responsibility can be submitted directly to the prosecutor's office or submitted to the local police commissioner at the place of residence.
